All prices are in CAD. A $325 cleaning fee + 16% taxes + $1000 refundable damage deposit will be added to the rental fee. VISA and Mastercard are accepted with a 4% credit card convenience fee.
Minimum Age Requirement 1. You must be 25 years of age to rent a home. 2. You must be present at the house for a majority of the reservation. As the signatory on this contract, you are responsible for the behavior of and any charges incurred by your guests. Respect Maximum Occupancy and Extra Guest Policy 1. Maximum occupancy includes all people 2 years & older; no additional overnight guests. 2. If we discover unauthorized excess guests or an unapproved party has been held at the home, we will require their immediate departure, will result in a loss of your damage deposit and /or termination of your booking. Any use of the home for other than strictly family vacation purposes or any non-permitted occupants may result in the termination of this contract and eviction from the premises. 3. Occupancy rules also apply to cases where a guest has rented more than one house. Refunds/Cancellation/Early Departure/Unavailability 1. We refund for cancellation or early departure only to the extent we can re-book the house less a $200 admin fee. Please buy trip/cancellation insurance. Refunds for cancellation are processed by the end of the month the cancellation is made. 3. We reserve the right to move you to a comparable house if the house subject to the Booking Agreement becomes unavailable. If you opt for a more expensive replacement house, you will pay the difference. Only if we can’t move you to a comparable home will we issue a full refund. We will not be liable for any collateral expenses or emotional harm from the unavailability of a home due to circumstances beyond our control. 4. We do not refund for problems we were not notified of during your stay and/or not given the chance to fix. 5. There will be no refunds or adjustments made for any other unexpected situation beyond our control such as mechanical breakdown or failure, rodents or insects, or acts of nature (some examples are: smoke in the air as a result of forest fires in the area, landslides, road closures, delayed flights). Mountain roads can be curvy and steep. We highly recommend four wheel drive and/or chains during the snow months. We do not refund due to road conditions. No refunds for delayed arrivals or early departures. Quiet Hours 10pm-8am and No Excessive Noise 1. Please respect your neighbors and when outside and realize noise carries easily in the backyards. You may be outside as well use the hot tub outside the quiet hours just be aware. 2. No outdoor amplified sound is allowed anytime. You will be responsible for any call out fees associated with your group up to $200+ tax per occurrence. 3. If there are repeat noise violation occurs, or you are found to be having or had a loud party, and/or unauthorized excess guests, this will result in a loss of your damage deposit and /or termination of your booking. Local Transportation 1. There is a free shuttle that takes you to the village and lifts that runs every 3-5 minutes during peak times. You will be provided a starter of kitchen as well as bath essentials. If you run out you will be responsible for your supply the remainder of your stay. The IGA located in Marketplace, in addition to Nester’s across Hwy 99 are Whistler’s best provisioners. Both are approximately 2 blocks for your home. IGA is very broad line while Nester’s is more a local upscale market with a broader selection of specialty foods. General Rules and Regs 1. No Smoking is allowed inside the homes. Smoking “anything” in the home during your stay will result in the loss of your refundable damage deposit. 2. No Candles to be burned inside or outside the home. 3. Please take your shoes off when you enter the home. 4. When you rent a property, you assume full responsibility for it and its contents, as well as your personal property. 5. While Whistler is a safe place, please lock all doors and windows when not in residence and we highly suggest that all windows and doors remained closed and locked whenever possible. Call Us Immediately With Any Problems 1. The home will be cleaned for your arrival. We will make arrangements to have enough linens for all persons in your party. House cleaning will take place after the end of your stay. 2. If the unit requires extensive cleaning upon your departure these fees will be taken from your damage deposit. 3. There is a washer and dryer for your personal use. Call Us Immediately With Any Problems 1. Your check-in packet will identify a local contact person to notify of any deficiencies during your stay. 2. We need to know about any problem relating to the property, including condition of hot tub, cleaning issues and damage, especially anything hazardous, so that we can inspect and fix the problem ASAP. 3. We ask you to unblock your own toilets (or if needed we can arrange for a plumber, at your expense if necessary.) Do not flush anything other than toilet paper down the toilets. 4. We do not refund for problems we were not notified of during your stay and/or not given the chance to fix. 5. We sometimes issue partial refunds, at our discretion, for malfunctions of major equipment at our homes but only if we are notified immediately and given an opportunity to resolve the problem. We do not refund or let you change homes for minor conditions beyond our control, brief water or or plumbing issues, or cable TV blackouts, Internet outage or internet incompatibility. 6. We cannot guarantee that spas, air conditioners, heater, televisions, appliances, high speed access, etc. will not break down during your stay and therefore, no refunds or adjustments will be made for mechanical failure Furthermore, there will be no refunds or adjustments made for any other unexpected situation beyond our control such as rodents or insects, weather and the like. No Temporary Structure 1. Our By-laws prohibits tents, yurts and RVs. Making Phone Calls 1. You are able to make local calls only on the landline provided in the home for free. Should you need to make out of area phone calls you will need a calling card. Hot Tub 1. Hot Tubs: If there is any problem with a hot tub, notify us immediately. If at the completion of your stay the hot tub is left in an inadequate condition for the next guest to use, after a “normal” chemical service, the hot tub will be emptied at your expense, to restore balance. All of our hot tubs receive a regular weekly maintenance, which may fall during your visit. 2. All guests use hot tubs at their own risk. Always watch your children around water. No glass in or around hot tub. Replace cover after use. Keep tub filled to one inch above highest jet. Do not remove the chlorinator/floater. Keep temperature set between 95 – 100. 3 . By signing the rental agreement, you agree to hold AZ 2126, dba: Our Whistler Retreat, its owners and employees, as well as the owners of your vacation home harmless and to indemnify them for any injury, loss, claim or damage resulting from the use of the hot tub located at the vacation home by you and any members of your party. The use of the hot tub entail certain significant risks which you are expressly assuming for yourself and all members of your party. You are further agreeing that no one pregnant, intoxicated, or who has a heart condition or other health problem that might create a further risk of harm will use the swimming pool or the hot tub during the duration of your rental. Allow Us Entry to the House 1. We reserve the right to enter the home during your rental, if we believe this Rental Agreement has been violated. In case of Eviction We agree that AZ 2126 – dba: Our Whistler Retreat reserves the right to refuse or interrupt service to any customer who breeches the policies and guidelines set forth in this policy document. In the case of eviction a refund of the damage deposit and unused portion of rental monies are forfeited. Check-Out by 10 AM 1. Our housekeeping/maintenance schedule is tight. When possible we will allow for a late checkout no later than 12 noon. If pre-arranged, the cost for a check out after 12 noon is $250. 2. The penalty for late departure ½ hour after the check out time is $ 60 leaving more than ½ hour past the check time will be charged to your damage deposit at $100/hour. This is do to the fact that the cleaners are on the payroll clock during the time they waiting for you to vacate. Check-Out Requirements 1. For your convenience, we will provide a checklist with your Check-in documents. 2. Be certain to haul your excess trash, wash dirty dishes, clean up after your pet if you stayed in a pet friendly unit. If you’ve rented more than one house, make sure all items are returned to original house. 3. Lock doors and windows every time you leave the house. You will be responsible for any damages that come from leaving a house unsecured. 4. Check closets, drawers, and under the beds; for personal items as well be sure you have all battery chargers. 5. OWR assumes no responsibility for lost or stolen items. 6. There is a $25 charge minimum charge to retrieve and return items left behind. Damage Deposit Refunds 1. Damage deposits will be refunded approximately 7 days after departure provided a satisfactory inspection report is received from housekeeping after check-out. 2. Examples of items, that would result in partial or full forfeiture of damage deposit funds include but are not limited to: Any items placed by the fireplace and damaged due to the excessive heat put off from the fireplace. Any damage caused by not turning the fireplace off at bedtime and when you are not in the home. Damage caused by heat or fire by not performing this task will be the responsibility of the renter. Any additional cleaning services required due to the condition in which the home is left Any security company call outs made to the home during your stay as a result of a complaint. Repairing or replacing items due to negligence or accidental breakage during rental period Any damage caused to the premises due to negligence on behalf of the renter Replacement or locating of any missing inventory of their home. Smoking in unit at anytime OR for bringing a pet into the home without prior knowledge and pproval. Any unecessary service calls made to the unit at the guest request. Breaching any portion of this contract Changing or unplugging any of the AV components, this will alter the system and require a service all Any false information provided will result in the forfeiture of your damage deposit 3. You agree Our Whistler Retreat may charge your credit card on file for any fees, charges or penalties assessed under the terms of the contract, including damages not covered by Damage Deposit and items removed from the house with the understanding that, if the actual or neighboring properties, whether accidentally or purposefully. You expressly agree that we may charge your credit card the amount of a professional estimate of repair for damages. We will refund the difference. If the actual amount is more, you give us permission to charge thedifference to your card. Release from Loss, Damage, and Injury 1. The guest hereby waives and releases any claims against owner, owner's rental agent, successors, assigns, employees or representatives, officiallyor otherwise, for any injuries or death that may be sustained by guest on or near or adjacent to the property, including the facilities.guest agrees to use the facilities entirely at the guest's. own initiative, risk, and responsibility. 2. Guest acknowledges and agrees that Guest will be responsible for and will assume the risk for any of Guest's minor. family members, guests, or invitees that use the facilities. Guest hereby agrees to supervise any children, non-swimmers, individuals with physical or mental defects, and all others using the facilities and to take full responsibility for their supervision. 3. Guest agrees to defend, indemnify and hold harmless the Owner, Owner's rental agents, successors, assigns, employees or representatives, officially or representatives due to any claims relating to injuries or death that may be sustained by Guests in, on or near or adjacent to the resort property duringthe rental term. 4. This legal instrument may be pleaded as a complete defense to any action or other proceeding, which may be brought, instituted or taken by the undersigned, the undersigned's family, other Guest invitees or Property users, in breach of this instrument. If any provision of this release is declared invalid or unenforceable, the remaining portions of the release shall not be affected thereby and shall be fully enforced. 5. This agreement shall be binding upon the heirs, personal representatives, executors, administrators, successors and assigns of the undersigned.
